In a crucial judgment, the Andhra Pradesh High Court directed the withdrawal of a Look-Out Circular (LOC) issued against the Petitioner in connection with a case registered at Samalkot Police Station, Kakinada District.
The petitioner’s counsel Rozedar S.R.A, argued that the action of the Police Officials did not adhere to the guidelines set forth by the Ministry of Home Affairs and lacked justification under the circumstances and the issuance of the LOC was arbitrary, illegal, and in violation of the individual’s fundamental rights under Article 21 of the Constitution of India.
The Court referenced an earlier ruling from 2019, where it had held that maintaining an LOC after legal proceedings were stayed was an unjust exercise of authority. In that case, the Court ordered the recall of the LOC, emphasizing adherence to due process and established legal principles. Taking into account the arguments and the principles laid out in the earlier ruling, the Court found the issuance of the LOC to be unlawful and ordered the authorities to withdraw the LOC within a period of one week.
